Rules
The 2010 Homemade Halloween Costume Contest (the "Contest") is sponsored by Parenting Magazine, a publication of Bonnier Corporation ("Sponsor").
ONE (1) GRAND PRIZE will win a total of three (3) products: one (1) Disney Princess Singing Belle Doll, one (1) Disney Princess Singing Rapunzel Doll and one (1) U-COMMAND BUZZ LIGHTYEAR from Disney and Thinkway, approximate value $138.99.
ELIGIBILITY: The Contest is open only to individuals; organizational entries are not permitted, nor are professional costume designer entries. Employees of Bonnier Corporation and its parent companies, subsidiaries or agents, their immediate families (defined as parents, children, siblings, spouse and grandparents), and those domiciled with any of the foregoing are not eligible. NO PURCHASE NECESSARY TO ENTER OR WIN. Purchasing will not increase your chances of winning.
TO ENTER: Submit an original color photo of your child wearing their homemade Halloween costume at http://www.parenting.com/Baby/halloweencontest/. Fill out the online entry form and upload your photo following the directions on the page. Entries must be received before 11:59 P.M. EDT on November 2, 2010. All information provided by entrant must be complete, true and correct. Photo must have been taken within one month of entry, and cannot be the product of a professional photographer. No slides or black and white photos accepted. Every entrant must be the parent or legal guardian of the Child featured in the submitted photo and must be 19 years of age or older. Entrant represents and warrants that the submitted photograph is an original, non-published work that does not infringe any privacy, intellectual property or other rights of any third parties. By entering, entrant represents that he or she owns or has the rights to convey any and all right and title in the submitted photo; and by entering, entrant conveys and assigns to Parenting.com all rights of ownership, title, interest and all other intellectual property rights, including without limitation, copyright in and to the photo, should it be the winning photo. All other entrants (i.e. those whose entries are not the winning photograph), by entering the contest, grant Sponsors a non-exclusive, worldwide, royalty-free copyright license to publish their submitted photos, if Sponsors choose, and to republish them at any time in the future in any and all media.
Each entry must be submitted on an individual basis (i.e., no team, joint, or corporate entries) and all components of the entry must be the original creation of the submitting participant. Only non-commercial work may be submitted. Entries may not contain profanity, nudity, pornographic images, violent images, anti-competition messages, illegal material, or material that violates the rights of third parties. Entries may not include confidential information, trade secrets, trademarks or copyrighted material belonging to any person or entity other than the participant absent a suitable license or permission agreement (proof of which is required). Entries containing any forbidden matter or material otherwise deemed by Sponsor to be inappropriate will be disqualified. Online entries will be deemed submitted by the authorized account holder of the e-mail address submitted at time of entry. One entry per person; multiple entries will be disqualified.
NOTICE TO ONLINE ENTRANTS
In the event of a dispute over the identity of an online entrant, entry will be deemed submitted by the "Authorized Account Holder" of the e-mail address submitted at time of entry. Authorized Account Holder means the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Entry materials/data that have been tampered with or altered, or mass entries or entries generated by a script, macro or use of automated devices are void. The Sponsors are not responsible for: (i) lost, late, misdirected, damaged, illegible or postage due mail/entries; or (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsors on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; or (iii) any injury or damage to entrant's or any other person's computer related to or resulting from participating in the contest. By participating in the contest, you (i) agree to be bound by these official rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of the Sponsors, which are final and binding in all matters relating to the contest. Failure to comply with these official rules may result in disqualification from the contest. Sponsors reserve the right to: (i) permanently disqualify from the contest any person it believes has intentionally violated these official rules; and (ii) withdraw the online method of entry if it becomes technically corrupted, (including if a computer virus or system malfunction inalterably impairs its ability to conduct the contest), and select winner from among all eligible entries received prior to withdrawal.
LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER OR VANDALIZE THIS WEB SITE OR INTERFERE WITH THE OPERATION OF THE CONTEST, IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
Contest entrants will also have the opportunity to vote on their favorite costumes submitted by other users, or on their own entry, as many times as they would like. The votes DO NOT count towards the selection of the contest's grand prize winner. Votes solely determine which costume will be selected as Costume of the Week. No prize will be awarded for Costume of the Week selections. The vote counter will reset at 4pm every Friday during the entry period.
JUDGING: A panel of judges consisting of Parenting.com editors will select the winning entry. By entering, you agree to be bound by these Official Rules, and that the decisions of the judges are final and binding in all respects. Judging will be completed by November 8, 2010 and potential winners will be notified by email or phone on or before November 12, 2010. Sponsor reserves the right not to select any winning submissions based upon the quantity or content of submissions. Potential winners will be required to sign and return a sworn Affidavit of Eligibility and Liability and Publicity Release. If required documentation is not returned within seven (7) business days of notification, or if notification is returned as undeliverable, any prize will be forfeited and an alternate winner will be selected.
PRIZE AWARDS: Prizes will be awarded within sixty (60) days after winner verification. No prize substitution or transfer is permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value for any reason. All taxes and any other incidental expenses on Prizes are the sole responsibility of each winner.
GENERAL RULES & LIMITATIONS: By entering, you represent that: (i) your entry is your own original work; and (ii) you have the right to convey any and all right and title in any material submitted as part of your entry into the Contest. By entering, you grant to Sponsor a perpetual, irrevocable, non-exclusive, worldwide, royalty-free license to edit, publish, promote, republish at any time in the future and otherwise use your submission, along with your name and likeness, in any and all media for any purpose, without further permission, notice or compensation (except where prohibited by law). Nothing in these rules shall obligate Sponsor to publish or otherwise use any materials submitted in connection with the Contest. By participating in the Contest, you agree to release Sponsor and its parent companies, affiliates, subsidiaries, employees, directors, officers, and agents from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses to persons and property which may be sustained in connection with the receipt, ownership, possession, use, or misuse of any prize. Sponsor is not responsible for technical, hardware or software failures, or other errors or problems which may occur in connection with the Contest, whether computer, network, technical, mechanical, typographical, printing, human or otherwise, including, without limitation, errors or problems which may occur in connection with the administration of the Contest, the processing or judging of entries, the announcement of the prizes, in any Contest-related materials, or that may limit prize fulfillment or a participant's ability to enter the Contest. Sponsor reserves the right to amend these official rules and to permanently disqualify from the Contest any person it believes has intentionally violated these official rules.
PRIVACY: By entering, you agree that the information you provide may be sent to promotional partners of Sponsor. You may be contacted by Sponsor and/or promotional partners with future promotional offers. Information provided by you to participate in this Contest is subject to the privacy policies of Sponsor.
