After Infant Deaths, CPSC to Sue Nap Nanny Makers

The Consumer Product Safety Commission (CPSC) is taking the manufacturers of the Nap Nanny, Baby Matters LLC, to court for not voluntarily recalling their product after five infants died and others incurred injuries.
The Nap Nanny is a shaped foam recliner where babies can rest or sleep. It has a three-point harness which is intended to prevent the child from falling out, but the CPSC received reports that infants fell out of the Nap Nanny even with the harness on. Nap Nanny injuries also occurred when it was used, albeit improperly, in a crib.
The Nap Nanny was officially recalled in July of 2010, but the CPSC feels Baby Matters, LLC has not done enough to warn consumers since then of the risks associated with using it. According to the CPSC, five infants have died using either the Nap Nanny Generation Two and the Chill model - it was an infant death that prompted the inital recall. Seventy other incidents of with children nearly falling out of the Nap Nanny were also reported.
In the complaint, the CPSC seeks an order for Baby Matters, LLC to notify consumers of the product defects and offer a full refund.
